Chimney regulations in Spain and Catalonia: what is compulsory and what is advisable
The law on domestic chimneys in Spain is complex and fragmented. Here we explain what the regulations say, what insurers require and what documentation you need.
In Spain there is no national regulation requiring annual cleaning of privately used chimneys, but the CTE, municipal bylaws, home insurance policies and residential communities may require it. Keeping documentary evidence of the annual inspection protects you legally and helps ensure insurance coverage.
Is there a legal obligation to sweep your chimney?
This is the question we are asked most. The short answer is: it depends. In Spain there is no single national rule requiring the owner of a detached home to have the chimney swept at a set frequency. That does not mean there are no obligations.
The Spanish building code, the Código Técnico de la Edificación (CTE), sets minimum requirements for combustion and ventilation installations in its basic health and hygiene document. The autonomous communities may add regulations of their own. And home insurance policies and residents' associations may include specific clauses on the maintenance of combustion installations.
The CTE and domestic combustion installations
The CTE governs the design and construction of chimneys and flues in new buildings and in refurbishments. As regards maintenance, it states that thermal installations must be kept in safe working condition, which implies periodic inspections.
The RITE (Reglamento de Instalaciones Térmicas en Edificios, the regulation on thermal installations in buildings) supplements the CTE with more specific requirements for heating systems. It applies mainly to communal installations and to buildings of a certain size. For detached homes with a wood-burning fireplace the RITE requirements are lighter, but the general safety framework still applies.
What home insurance policies say
This is the part that affects private householders most. Most home insurance policies cover fire damage, but they can exclude or limit that cover if the fire started in a chimney that has not been properly inspected and maintained.
In the event of a claim, the insurer may ask for documents proving that the installation has been maintained. If you cannot produce an inspection report, it may argue that you failed in your duty of upkeep and reduce or refuse the payout.
Having a detailed service report issued by a professional technician protects you in that situation. We document the condition of the flue, the work carried out and any relevant observations. That report is what your insurer will ask for if you ever need it.
Regulations in Catalonia
In Catalonia, the Codi d'Accessibilitat and the municipal by-laws add specific requirements depending on the town. Barcelona, Girona, Tarragona and Lleida have safety and fire by-laws that may include maintenance requirements for combustion installations.
Residents' associations can also set out in their statutes an obligation to inspect private installations that share flues or façades with communal areas. If you own a flat in a building with communal chimneys or flues, check your association's statutes.
In practice: what should you do?
Regardless of strict legal obligations, an annual chimney inspection is the best safety investment you can make. It spots problems before they turn into hazards, keeps your insurance cover intact and maintains the performance of the appliance.
